1. Use of the Fitness Store Website
All products are sold subject to the terms and conditions listed here. Please read them carefully before using the website. By using the thefitnessstore.co.uk site you signify your agreement to be bound by these terms and conditions.
2. Order process
To place an order you will be guided through a series of simple steps on our website. Payment details are taken from your card. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from The Fitness Store.
Order acceptance and the completion of the contract will take place on the dispatch to you of the goods ordered unless we have notified you that we do not accept your order. Non acceptance of an order may be due to: the product being unavailable, non-authorisation of payment or identification of an error in pricing or product description.
Payment for goods can be made by any method indicated on our website. Payment should be made and funds cleared before goods have been dispatched. If we unable to supply any goods, we will inform you at the earliest time and a full refund will be given if you have already paid for the goods.
As your goods are dispatched from our warehouse will send you a dispatch confirmation email. The creation of the contract between you and us will take place at the point the goods you have ordered are dispatched from our warehouse to be delivered to the designated address.
Distance Selling Regulations
Under the Distance Selling Regulations you have a right to cancel your order for any item purchased on this website for a full refund. This does not apply to items made to your specification; special orders not on the website, perishable goods (e.g. food/supplements)and goods purchased in store.
DELIVERIES: Very Important !
If you live in an unusual building, such as a block of flats or an apartment, please read very carefully the delivery notes below. Please call us on 01752 601400 or email us at firstname.lastname@example.org, if you have any doubts at all. We will be, only to happy to help.
Delivery (One Man) Smaller items
All orders are processed and shipped as soon as possible. Normal delivery time is 5 to 7 working days. Please note that unless the carrier/supplier offers a delivery booking in service your order will arrive without prior notification. A card will be left if no one is home & the goods returned to the carriers local depot to await your contact. Delivery times may increase around holidays and peak shipping seasons. Please telephone to confirm current delivery times.
The freight delivery service you receive may vary among carrier companies. Since most carriers deliver to the curb side immediately adjacent to their vehicle and regard inside delivery as an extra service cost, it may be necessary for you to assist or move merchandise into your home, this is especially relevant if you live in a block of flats as carriers will only deliver to the ground floor entrance to the block. If you have alternative delivery requirements, please contact The Fitness Store. Be sure to include one or two phone numbers in case the carrier needs to notify you to arrange delivery.
All deliveries are made Monday - Friday between 7am & 6pm. Our carriers are unable to give specific times for delivery.
Delivery (Two Man) - Larger or heavier items
This service is available on larger or premium priced products (check at time of order). Although the carrier will place the product in the ground floor room of your choice, this is subject to good and safe access. Please note: Due to Health & Safety regulations deliveries above or below ground floor are at the carriers discretion and are not guaranteed. This includes steps that are immediately outside the premises and are required to climb in order to gain access to the property. Please allow at least 10 working days for this service. All deliveries are made Monday - Friday between 8am & 6pm. Our carriers are unable to give specific times for delivery.
If it is found that the product will not fit through/round any doors/stairwells etc and the product is subsequently returned, you are responsible for all outward & return carriage costs. These larger products have pre-arranged deliveries, which means the item will be booked in with you by the carrier or the supplier. If when the carrier arrives with your goods after pre-arrangement and there is no-one present to receive them, they will be returned to the carriers depot, or to the supplier. In this case you will be liable for ALL charges for re-delivery. Please note, if the order is subsequently cancelled, you will be liable for all carriage charges.
Non UK Mainland Warranties
If you live outside the UK it is advisable that you check if the product you are wishing to purchase will have any warranty outside the UK.
Labour warranties for UK offshore postcodes may not be available. Please check before ordering. This is applicable to ALL offshore postcodes including Isle of Wight & Isle of Mann etc.

All orders in our catalogues & on our website over £150.00 are delivered FREE to mainland UK addresses, excluding (but not limited to) the following postcodes: BT, HS, IV, AB, PH, PA, DD, KW and all offshore postcodes. There may be a delivery surcharge to these postcodes.
Please note that delivery is free to BT postcodes on orders exceeding £700 in value, but with some manufacturers, we may not be able to send large items (To comply with some manufactures warranties we are unable to offer a free one man delivery service to BT postcodes on a small selection of products, therefore a surcharge will apply.

Due to the size of some delivery vehicles, The Fitness Store or any carriers delivering on behalf of us MUST be informed of ANY restrictions regarding access for the delivering vehicles. This includes but not limited to, steps (including those required to climb to gain access to the property entrance), any overhanging/low trees/shrubs, steep driveways, narrow lanes, tight bends or any other restrictions that may make it difficult for the delivering vehicle to gain access to the point of delivery. The Fitness Store will not accept any claims for compensation arising from non/failed/refused delivery of any item where the carriers or we were not made aware of any points regarding access restrictions. In the event that the item is refused/cancelled due to these restrictions, the customer is liable for all carriage charges & a 15% re-stocking fee will be applied.
All installation prices quoted on our website are for ground floor installations in Devon, Cornwall, Dorset and Somerset.
If your installation address is outside of these counties, we will contact you prior to processing payment if the charge is more than the figure stated. If you require further information please contact us on 01752 601400 for a cost prior to ordering. We regret we are unable to accommodate installations to offshore postcodes.
If you require installation, the time between order & installation may be longer than for that of delivery only.
We will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.
It is imperative that the space for the product/s has been cleared & that access is unrestricted. If the installer is unable to commence work due to the area not being cleared or access not being available at the agreed time The Fitness Store reserves the right to charge Â£20 for every half hour the installation engineer is unable to start work. We must be informed at the time of placing the order where the product/s are to be installed. All prices quoted are for ground floor installations in the main building of the property or a garage at side of the main part of the building. Installations above or below ground floor or outside the main building i.e. an outhouse etc may be subject to surcharge, especially if not mentioned at the time of order. You may be asked to assist the installer to get the product/s to their location, if no help is available then a 2 man installation may be required at extra cost.
The Fitness Store is within it's rights to refuse any installation if the installer deems the installation location to be hazardous or the request unreasonable. If the product does not fit into the area where the installation is requested & a representative of The Fitness Store did not measure the area, then The Fitness Store cannot be held responsible, therefore the customer will incur the cost of the visit. Agreed installation times must be adhered too.
Adequate parking / vehicle access must be provided by the customer. Any charges incurred by the installer for parking etc will be chargeable. If the installation time is extended by there being inadequate parking / access then the extra time will also be chargeable at Â£50 per hour.
Request For Specific Delivery Date Orders
It may be possible to request delivery for a specific date. The Fitness Store will endeavour to make this happen but it cannot be guaranteed. The Fitness Store will not entertain any claim whatsoever for compensation arising from late delivery due to a third party carrier.
If it is found that any of the larger products upon delivery will not fit through any doors/stairwells etc and the product is subsequently returned/refused, you are responsible for all outward & return carriage costs incurred by The Fitness Store. Please also see Restricted Access terms. We would therefore recommend that you ensure the product will fit and can be transported to its ground floor point of installation easily. If you need to confirm the boxed dimensions of a product please call The Fitness Store prior to placing your order.
We or our carriers will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.
Short Deliveries & Damage To Packaging
When the delivering carrier brings your order you MUST count the pieces you receive & look for any damage to the packaging. It is noted on the carriers delivery note, the number of boxes you should receive. If the number of boxes you receive does not exactly match the number of pieces on the carriers delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to packaging MUST be noted on the delivery note next to your signature. You must cross out "delivered in good condition" from the carriers delivery note. It is very important to check your order. A signature is an acceptance that you have received the whole order & that the packaging was in good condition.
Any short delivery of boxes must be reported to The Fitness Store within 48 hours of signing. Neither The Fitness Store nor the delivering carrier can be held responsible for short deliveries or damages to packaging if you do not note them on your delivery note. This does not affect your statutory rights in the event of the goods being faulty. The customer is asked to examine the goods as soon as reasonably possible after delivery & notify us of any fault or damage as soon as reasonably possible.
Collection Of Faulty Products
In the event of an item being received that either develops a fault (proof of purchase will be required) or is found to be faulty upon delivery, we will arrange to have this item collected free of charge or an engineer to call at the discretion of the manufacturer. Items for collection must be packed in secure appropriate packaging and be made available for collection by our carriers within 24hrs of you notifying us they are faulty. If when the carrier arrives to collect the goods, they are found not to be available/ready, a charge, which will be payable by you, will be made for the carrier to recollect.
Once the items are received back at The Fitness Store, we will inspect the product(s), and if necessary arrange to send out a replacement product. Please note that if the product is found on inspection NOT to be faulty we may send this item back to you, and all delivery charges will be payable by you. Please note that if proof of purchase cannot be shown, then we reserve the right to charge for any/all repairs.
WEEE (Waste Electrical and Electronic Equipment) Regulations
Each EU Member State now has a legal obligation to minimise the disposal of WEEE in landfill sites.
The broad aim of the WEEE regulations is to address the environmental impacts of electrical and electronic equipment when it reaches the end of its life.
We all have a responsibility to contributing to the reuse, recycling and other forms of recovery of WEEE under these Regulations
Over 75% of waste electrical goods end up in landfill, where lead and other toxins contained in the electrical goods can cause soil and water contamination which can lead to negative effects on human health and the environment.
Electrical and Electronic Equipment that was made after 13th August 2005 should display the crossed-out wheelie bin symbol on the packaging or product. The purpose of the symbol is to encourage householders to dispose of their WEEE separately from household waste.
What can you do?
If your old machine is still working, do you know somebody who would like to use it? There are many organisations such as schools, clubs, residential homes etc. who would be very happy to have the use of your old equipment.
In addition there are organisations that will reuse and repair electrical and electronic equipment, and some even run "cash for recycling" schemes.
If your old equipment is no longer useful, please recycle it.
Alternatively, as a distributor we are committed to reducing the amount of WEEE that goes in to land fill. We are doing our bit for the environment by offering free take-back on a like for like basis when you purchase a new machine from us. This means, for example that if you buy a new cross trainer from us, you can return your old cross trainer to us and we will arrange appropriate disposal of the old machine. (Please note it must be a similar product - e.g. an old exercise bike for a new one, an old step machine for a new one, etc.) This must be arranged with us at the time of placing an order with us for the new product, so if you would like to do this please call us on 01752 601400 for details of where to deliver your old machine.
5. Description of goods
We have made every effort to display the products featured as accurately as possible. However, we cannot guarantee that your monitor's display of the colour, texture or detail of the good will be exactly the same as the actual product.
We try to ensure that prices are up to date and accurate but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price. If we are unable to contact you we will treat the order as cancelled. We will not accept an order if there is a pricing error.
6. Cancellation of goods
Under The Consumer Contracts Regulations 2013, you are entitled to cancel your order you have placed. You may exercise your right up to 14 days, starting from the day after the goods were received. If you cancel an order after the goods have been delivered you must send them back at your own cost or you will be charged the actual cost of collecting them. The goods must still be in 'as new' condition. Please follow the procedure set out in our returns procedure.
All goods are covered by a manufacturer's warranty against faulty workmanship and materials, subject to the terms and conditions of that warranty. The manufacturer's warranty is provided in addition to your consumer rights and do not affect your statutory rights.
If you are ordering from overseas you may be subject to import duties and taxes, which occur once the goods reach the specified destination. Any additional charges incurred at this point are your responsibility and must be borne by you. For further information please contact your local customs office as policies differ from country to country.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
10. Returns Procedure
If, for any reason you need to return anything to us, you must first raise a returns reference number. Failing to do this can result in delays in handling your return. In order to raise a returns reference number, please use the Contact Us form. You will need the email address with which you made the purchase, and your invoice number.This does not apply to in store purchases.
Conditions for Return:
Items arrived damaged: Complete the form, giving full description of damage. If items delivered by courier, we will arrange collection immediately, or we kindly ask you to return the items by post. Upon confirmation of reciept of damaged goods back to us we wil refund any expenses incured and refund or replace the goods. Items are not as described or faulty: Procedure is as above. It is our responsibility to ensure that goods arrive with you in good working order.
